What we learn from history is that we do not learn from history. That's Identity theft. For some reason, these many horror stories appear to leave little or no impression on the public. Profoundly hard to understand.

We're sure you wouldn't drink a quart of milk just before riding a roller-coaster. You wouldn't enjoy the ride any more than you'd enjoy the response if you were to walk into a crowded bikers' bar and loudly yell, "You're all a bunch of pussies." We're sure that, on both counts, restraint would hold sway. In fact, you'd most likely flip to the other extreme. Why, then, at this other extreme,do so many people choose to live on the edge when it comes to guarding their identity against theft, when anyone can easily do so? This is one of the big riddles of modern life. A real puzzler. Too much restraint.

Look all around you. We all live in a highly commercialized world. This is a generally-accepted reality. Unfortunately, this very same stage of civilized advancement creates a throwback jungle to navigate, populated by con men at every turn. And, there we all are. Machete in hand, we must cut our way through this civilized thicket--every step of the way--carefully avoiding the headhunter identity thief hiding behind every bush.

Now, though, you can be the master of these shell games instead of the con men, move the peanuts around yourself. In past articles we've covered many of the essential defensive moves you can take. There are still more. Here they are:

> You don't want your credit status to be flypaper for con men. Review your consumer credit reports annually. Do this more frequently at the first hint of wrong-doing. It is important to know early in the game if anyone is opening accounts in your name without your consent. The 3 credit reporting agencies (and toll-free phone numbers) are:

Equifax, 800-525-6285. Experian, 888-397-3742, Trans Union, 800-680-7289.

> Never use your date of birth as a password. Same for your age. Too much help for the guessers. Using these dates would be like giving Bonnie and Clyde "his" and "her" shotguns.

> Never leave, intact, receipts behind--at ATMs,, on counters, at financial institutions, or at gas pumps. Reason for this should be misunderstood only by those with a room temperature I.Q.

> If you don't get a replacement credit card before your present one expires, complain loudly. In fact, it's probably a good idea to complain at least 30 days prior to expiration. Many do not realize it, but the internal policy of the credit card issuers is to send these out well in advance of deadline. Only ignore if you like the whooshing sound of deadlines as they go flying by.

> Same for monthly bills and financial statements. You do not want the computerized footprint of these to loiter in cyberspace too long, easily accessible by con men. Complain. Make sparks, if necessary. Sure, friction can be a drag, but overexposure can cause you a severe case of financial pneumonia.

Lawyer TV Ads: A word to the wise Did you know that there are companies that offer prewritten and pre-shot TV commercials for personal injury attorneys? You've probably seen one. Sometimes a famous actor is used (like Robert Vaughan, William Shatner or Eric Estrada). Other times an attractive man or woman is shown speaking behind a desk or holding a legal book or doing something else to act like a lawyer. The person says something like, ¡§If you've been in an accident, get the money you deserve. Speak to an attorney for free. Call 1-800-XXXXXXX.¡¨ What you need to know is that many times your call is routed to a call center that randomly sends your call to the next attorney ¡§in line.¡¨ The next one "in line" is an attorney who has actually paid a hefty fee to be on the ¡§list.¡¨ Any attorney with enough money can pay to be on the list, including attorneys who have never tried a case in court. Many times the attorney who has paid the fee is not necessarily the most experienced lawyer for your case. Now I'm not saying that all attorneys who use TV advertising are inexperienced. But you should not rely on TV advertising alone when choosing a lawyer. Just a word to the wise.

Case Study: T.V. Personal Injury Lawyer Fails Client

Here's a sad story about a lawyer who advertised on T.V. in Rochester, New York. The attorney, Jim Schapiro, ran aggressive T.V. commercials which promised to obtain large financial settlements for victims, referred to himself as "the meanest, nastiest S.O.B. in town" and claimed to have aggressive courtroom prowess. Schapiro, who called himself "The Hammer" had law offices in the states of New York and Florida.

In 2002, one of Schapiro's clients, Christopher Wagner, sued Schapiro for malpractice. Mr. Wagner had been injured in a car accident and had responded to one of Mr. Schapiro's television ads. Mr. Wagner alleged that he had incurred medical bills of $182,000 but that Schapiro's firm advised him to accept a settlement of only $65,000 from the driver and then promised that he could get more money by filing suit against the state of New York. It turned out that the state had no liability for the accident and Schapiro never pursued Mr. Wagner's case further.

In a video deposition, Jim Schapiro testified that he had never tried a personal injury case in court and that he had been living in Florida for the last seven years. Mr. Wagner's attorney also discovered that Schapiro's Rochester law firm staffed just one lawyer who had only tried four cases. A New York jury found that Schapiro had engaged in misleading and deceptive advertising and that he committed malpractice. Schapiro was ordered to pay $1.5 million to Wagner.

Consequently, in 2004 Schapiro was suspended for practicing law for one year by the State of New York. In 2005, Schapiro was then suspended from practicing law in Florida for one year. In 2004, four additional clients sued Schapiro alleging that he had engaged in misleading advertising and had committed malpractice. Thereafter Schapiro stopped practicing law and instead now writes books for injury victims.

You need to know a few things about lawyer advertising. For example, if you look through the yellow pages you'll see that the ads placed by attorneys all say essentially the same thing. Very few of them actually give good useful information to make it easier for you to choose a good lawyer for your case. Although the yellow pages are a good place to get names of attorneys, you need to be aware of the following points when it comes to lawyer advertising:

**There is no rule which requires that the lawyer have a minimum amount of experience handling the case which the lawyer wants to advertise.

**Although the bar association has rules that govern lawyer advertising, it usually does not actively investigate, restrict or determine whether each lawyer who advertises is a specialist or has experience with the type of case being advertised. This means a lawyer can advertise that she is a "divorce lawyer" or "personal injury attorney"¨ when that lawyer may have limited experience or knowledge of that area of the law.

**There are virtually no restrictions on the different types of law that the lawyer wants to advertise. Therefore, you should be extremely careful about choosing an attorney based solely on that attorney's advertising claim, whether the ad is in the phone book or on television.

**Any attorney can buy a big slick ad in the yellow pages. The phone book company typically does not verify the claims that are being made in the ad. In many cases the phone book company does not even verify that the person is a licensed attorney in good standing! Use caution.

**A lawyer who advertises does not mean that that lawyer will be handling your case. Some lawyers simply run advertisements and then refer outermost or all of the clients to other lawyers to do the work in exchange for a referral fee. Such a lawyer essentially acts like a referral broker. Be especially cautious of ads placed by out of state attorneys. Because of state licensing requirements, these attorneys will usually have to refer the case to a lawyer who is licensed to practice law in Washington.

**A lawyer who purchases full page ads in the yellow pages, or pays for slick T.V. commercials, does not necessarily mean that the lawyer is super successful. Some lawyers who pay for such advertising operate a "volume practice" for the purpose of making just a little money on the numerous cases that are generated from the ad. Many times a "volume practice" attorney tries to settle all or most of the cases to earn the most amount of money in the least amount of time. The only time you may see this lawyer is if his face appears in the ad!

**Some lawyers who run big ads to fill their "volume practices" will rarely even work on a case. These lawyers farm out every aspect of the case to a paralegal or legal assistant. The only time the lawyer may even look at your case is after it has settled and the lawyer wants to collect his fee!

**Be cautious of lawyer ads that create unjustified expectations. For example, if the lawyer advertises that he can obtain "Fast Settlements in 30 Days" he probably never goes to trial and settles cases for far less than what they are actually worth. In most cases, good settlements take time and effort.

Law of Attraction – Be Like A Great Actor To Be Successful

What if I see something that causes me heartache or if I don't want to think about some bizarre experience?

If it is something you don't want, don't think about it, it's just that simple. For what you resist persist. The Law of Attraction cannot tell if you do not want the experience, especially since you keep thinking about it and wondering and predicting what you will do about it. Sensing that you want to keep creating more doubt, fear, anxiety, etc. because your energy is so focused on those types of experiences, the law says here's more. The more you concentrate on the unwanted object or experiences, the more energy you give it to grow. If it is something you truly desire, think about it to the point you can smell it, feel it and taste it and then "act as if you already have it in your life.

The next time you get into your old car, "act as if it's that new luxurious one you desire. Every time you get behind the wheel only believe, smell, and think of it as that new one. Start play-acting and pretend. Imagine you have the job, car, etc. and actually sense/visualize how you feel; insert yourself into the vision. Why? Because the universe does not distinguish between what is make believe and what is real. When you are pretending to the point that you actually believe you are in possession of the object of desire, then the universe matches it if you have mentally aligned with it and have physically made room for it.

How is this accomplished? Well, the universe doesn't have a mechanism to detect when you are pretending, so your consistent desirous thoughts about what you would love to experience is responded to as the real deal.

Go to the car dealership and sit in that luxurious new car. Go to the jeweler and try on that diamond ring, and sit in on a corporate meeting and get that feeling of entitlement in your soul. Start pretending, act as if now. Use this exercise daily. Start small then build to a bigger desire, you will need to feel confident and comfortable when you are acting as if. Remember, the subconscious mind doesn't distinguish between the real world and a virtual one. Acting as if will cost you nothing and there is not a great deal of energy expended. You simply incorporate the process into your normal daily routine.

Why pretend?

Pretending is like having access to a virtual reality game without being hooked up to any electronic equipment. Believing it's a game; the suspicious, cautious conscious mind will not reject, analyze or judge any of these thoughts against your current belief system because it views this exercise as play.

Just be like Angelina Jolie, Al Pacino, Tom Cruise or other great actors. They act it out and pretend that they're someone else according to their movie characters. You just need to act it our in your daily life.

Do not be deterred if others think you are acting weird, for it is through understanding and practicing the principles of the law that you will receive everything you believe and desire. Yes, it is the Law of Attraction and one of its real secrets is "if you believe it, you can achieve it." Only then can you have, be or do anything in your life if you desire it. Believing and having faith is the foundation for any desire to manifest.

What are the 5 Laws of Money?

In Physics, there are certain laws which stay true regardless of time, one example is the Law of Gravity. When it comes to personal finance, there are also certain laws.

In fact, there are 5 Laws of Money which I like to share with you:

1. Money comes gladly and in increasing quantity to any person who saves at least 10% of his/her earnings (first step to Financial Freedom).

There are only 3 Cashflow Scenarios:

a. You spend more than you earn: This person has negative cashflows and is likely to end up owing other people money.

b. You spend all that you earn: whether this person is earning S$2,000 a month or S$200,000 a month, he/she is just getting by and not getting ahead.

c. You spend less than you earn (eg. save 10% of your earnings). As time goes by, this person will automatically get richer and richer.

The question is which cashflow scenario do you want to CHOOSE for yourself?

2. Money can work for you, if you become the "wise owner" of money and make money work for you. (note: you're the Master, money is the slave, while many people are guilty of being slaves to money).

Money is just a tool. We should Love people, use money. The sad thing is there are people who Love money and use people instead.

3. Money will be safe and grow if you invest it wisely or if you invest under the advice of people who are wise in money. ie. investment knowledge is key to making money grow. You can either acquire investment knowledge yourself or you can invest money under the advice of people who have investment knowledge.

4. Money will slip away from the man who invests it in businesses or investments with which he is not familiar with. You should ask the opinion of those who are wise in money, they might be able to offer you information or advice that can prevent you from losing money.

5. Money flees the man who falls into scams created by tricksters and conmen, who promise "impossible earnings". One common weakness of human beings is "greed". Greed can make a person who is usually alert and smart "stupid". Greed can blind a man and is the main reason why financial scams continue to exist whether in ancient times or in the modern day.

Thus, if you abide by the 5 laws of money, you will definitely get ahead financially and be able to accumulate wealth.

Notice Requirements Under The Mechanics Lien Law of Delaware

A Contractor’s Notice Obligations Under the Delaware Mechanic’s Lien Law

Pursuant to Section 2705 of the Delaware Code, a contractor is required to provide written notice of all persons providing labor or material. Such notice must be provided within ten days of the owner’s demand.

Section 2705 provides: “The owner of any structure built, repaired or altered by any contractor or subcontractor may require such contractor or subcontractor from time to time to furnish and submit to him a complete and accurate list in writing of all persons who have furnished labor or material, or both, in connection therewith, and who may be entitled to avail themselves of the provisions of this chapter. Should any such contractor or subcontractor fail to furnish such list for 10 days after demand made therefor by such owner, he shall be entitled to receive no further payments from the owner until such list be furnished and shall not be entitled to avail himself of any of the provisions of this chapter.”

In the case of Rockland Builders, Inc. v. Endowment Management LLC, et al., (July 10, 2006), the Delaware Supreme Court determined that a contractor’s failure to provide a timely response to the owner’s demand does not permanently preclude the contractor from filing a lien on the property. The Court ruled that the language in the statute is not intended to forever bar the contractor from obtaining payment of amounts outstanding or a lien on the property, but rather stays the contractor’s ability to receive payment or obtain a lien in order to provide an incentive to the contractor to provide such list to the owner. While a contractor “has no right of action or lien” until such list is provided (i.e. it “is a prerequisite to the attachment of the lien”), once the contractor does provide the requested list, it can once again avail itself of the mechanic’s lien statute. The fact that the list is not provided “until after the lien claim is filed is not fatal, provided it is served before the expiration of the time for filing the claim.”
