Trasylol Lawyers

By : Todd G
Trasylol is a drug that is used to prevent blood loss in patients who have had various types of cardiac procedures such as cardiac bypass surgery and coronary artery bypass graft surgery (CABG). Unfortunately, many have had complications from this drug, which is recently coming under heavy investigation. The drug maker Bayer Pharmaceuticals is facing heavy scrutiny as reports have shown that the use of this drug can increase heart attacks by 48 percent.

In addition to an increase in heart attacks, a current study of 4,400 patients has shown cases of heart failure increasing by 109% and stroke increases of 181%. Due to these statistics the FDA has issued an advisory for the drug regarding its safety. Doctors have also been contacted and urged to warn patients of the potential side effects from using Trasylol.

Medical experts are now in search for alternative treatments for Trasylol. They are searching for other drugs that will not cause these potentially life-threatening complications such as heart attack, stroke and kidney failure. Currently there are around 10,000 people who have experienced kidney failure and currently receive dialysis. There are currently two drugs that should perform the same way as Trasylol without the debilitating side effects. Unfortunately, Bayer Pharmaceuticals is refusing to acknowledge claims that their drug has caused any significant harm. They are arguing that tests conducted by the New England Journal of Medicine were performed wrong.

Besides heart attack, strokes and kidney failure, it is suspected that Trasylol is responsible for the death of some patients. The study performed by the New England Journal of Medicine suspects that the risk of death is increased by nearly 50 percent in patients who are administered Trasylol instead of alternative mediations. Death from this drug is an unfortunate and unnecessary complication because there are plenty of alternative sources that are virtually as effective but do not cause these harmful side effects.

Nursing Home Abuse Lawsuits - Lawyers

By: Todd G
With more and more of the United States population aging, nursing home and elderly communities are constantly expanding to help accommodate more patients. Tragically however, nursing home abuse of the elderly is becoming one of the most widespread crimes in America. Nursing home patients are vulnerable from many types of abuse ranging from physical violence to theft of property.

Many common types of nursing home abuse cases have been caused by under qualified and inexperienced staff members. Employees are sometimes unable to handle certain situations and have been known to take out their frustrations on residents of the nursing homes. Studies show that over half of the suspicious deaths researched in nursing homes might have been causes by neglect or negligence including dehydration and malnutrition.

Because of conditions such as dementia and Alzheimer’s, older adults are very vulnerable to abuse. History of domestic violence may also make certain seniors more susceptible to abuse in a nursing home.

Placing a loved one in a nursing home can be one of the most difficult decisions a loved one is forced to make. Often times this decision is very emotional, and not thought out entirely. When you enroll a loved one into a nursing home you are entrusting the caregivers with more than just money. You are entrusting them with a life of a loved one. In the event that a loved one has been victimized by the actions of a nursing home employee, it is your duty and right to seek legal attention. A compassionate, experienced nursing home abuse lawyer can help you understand your legal rights and guide you towards an appropriate course of action.

In addition to common types of nursing home abuse, there are also several other types of abuse. Mental, physical, neglect and exploitation are all other forms of abuse that can happen in nursing homes. Mental abuse can include fear, depression, withdrawal, behavior changes, weird behavior patterns, unwillingness to communicate and specific complains by the resident. Physical abuse can include cuts, burns, bruises, swelling, broken bones, restraints and other wounds. Neglect can include bed sores, smells of urine and feces, unkempt appearance, untreated medical conditions and other complaints. Explotation / Financial abuse can be the selling of property, missing or stolen property and specific complaints by the resident.

Many times a loved one has been a victim of the terrible and inhumane actions of a nursing home employee or supervisors. If this is the case, it’s your main concern to seek immediate and experienced medical treatment and then contact a lawyer. With such emotional conditions, it is often times very hard to remember the legal rights that the victim of the abuse has. The first step in pursuing your neglect case is to contact a qualified attorney. They will determine whether or not a legal claim should be made and whether or not the case should even be pursued. Contact an attorney today.

Dog Attack Lawyers

By : Todd G
Dog attacks have been a serious problem in the United States. Reports estimate that around twenty Americans each year are killed by dog attacks. To make things worse, children make up the majority of these victims, as around five million victims of dog attacks are under the age of 18. There are certain types of dog breeds that can actually view children as threats. Sometimes children don’t understand the dog’s motives, and end up getting themselves into trouble.

Since the late 1970’s dog attacks have been on the rise in the United States. Currently there are around 65 million dogs that live in the United States and each year more people bring more and more of these animals into their homes. Of course, owning a dog is not considered dangerous, but many owners overlook the potential risks that they present. The reality is, any dog might attack under the right circumstances.

It is very important that both dog owners and the victims of dog attacks know the dog attack regulations in their local area. Owners have a certain level of liability for the behavior of their pets, while the victims should also be aware of the regulations that affect their rights. For instance, in the United States most dog bite regulations say that the dog owner is liable for the dog’s behavior. While this is true in many cases, other circumstances to take into consideration include trespassing, veterinarians, felons, provocation and whether the dog was a police or military dog.

Dog bite regulations also include the ‘one bite rule’. This is a law that protects a dog owner from liability the first time his or her dog bites someone. However, there are some exceptions to this rule that include negligent or reckless conduct. If the same dog bites someone for the second time however, then the owner is held liable regardless of the circumstances behind the situation.

Everyday around 1,000 people will need to seek emergency medical attention because of dog bites. Not only do these attacks cause physical pain, but they can also psychologically scar the victim for many years. This is especially true if the victim is just a young child. But, since dogs are such common and popular household pets, victims may suffer from post-traumatic stress disorder that is so intense that they won’t be able to interact with any dogs for the rest of their lives.

About $1 billion is spent each year in medical bills, insurance premiums and lost work due to dog attacks. Sometimes homeowners insurance can cover the damages caused by a dog attack, but generally the cost of the attack is paid for out-of-pocket. Dog attack lawsuits can help a victim recover monetary compensation for their injuries.

If you or a loved one has been injured in a dog attack it is very important that you contact a dog bite attack lawyer today.

Lung Transplant Lawyer

By: Todd G
Many United States workers have manual labor jobs that require them to work in coal mines and other areas that require the use of dust respirators or masks. These masks help protect their lungs from harmful particles of dust in the air. These devices are supposed to purify the air, as workers inhale creating clean air for breathing. Since the late 1930’s respirators have been manufactured in the United States. Manufacturers of these divices include Mine Safety Appliances Company, 3M, Welsh-Norton, Moldex and a plethora of others.

Unfortunately, many types of respirators used by coal miners and asbestos workers are unsafe and have leaked harmful dust into the workers’ lungs. As a result of these defective respirators, workers have contracted many major medical illnesses such as mesothelioma, silicosis and black lung disease. These illnesses force the workers to undergo very complicated medical procedures such as lunch transplants as well as other major surgeries.

Lung transplant surgery is required to replace one, or both of the diseased lungs with healthy lungs from an organ donor. Because these procedures are becoming more and more common, the success rate is going up substantially. In 2004, around 1,200 patients received lung transplants and the number is on the rise for 2006. However, due to the overwhelming demand, and lack of supply for this procedure, many Americans are unable to get their operations.

The lung transplant procedure is generally the last resort for patients with chronic lung disease. Many times the reason that patients need these operations is because they have been using a defective respirator for far too long. These problems are categorized as ‘obstructive’ or ‘restrictive’ which relates to the volume of air the lungs can hold. Obstructive is when there’s a decrease in exhaled air flow, while Restrictive means a decrease in the total volume of air that the lungs can hold. Complications may also arise from these conditions which often times result in a lung transplant.

Victims of ailments such as silicosis, asbestosis and black lung often find it difficult to understand who’s at fault. Occupational injuries such as broken bones, burns, and cuts are easily recognized, but long term injuries such as lung disease are harder to pinpoint. The real tragedy is that many times these diseases were contracted after long hours of work with defective respirators. In many cases manufacturers of these respirators should be held liable for their negligence.

If you or someone you love has been affected by a respirator device that has leaked toxins then you need to seek a lawyer right away. A qualified lawyer can help you understand your legal rights and receive compensation for your injuries.

Sales: Using The Law Of Expectancy

By: Patrick K. Porter, Ph.D.
Studies in persuasion technology show that what you expect tends to be realized. I call this the Law of Expectation, which is also one of the tenants of sales.

As a sales professional, your expectations influence reality. I recently came across a movie called, "What the Bleep Do We Know?" It explains how our thoughts and intentions shape our reality. If you haven’t seen the movie, I urge you to do so. (You can go to www.whatthebleep.com/ to learn more.)

The movie explains that human behavior is directly related to how others expect us to perform. As an example, there was once a study in which first grade students were told that blue-eyed kids are smarter than brown-eyed kids. The blue-eyed children subsequently scored better on tests than their brown-eyed peers.

After several months they decided to bring the children together and tell them that what they'd told them before was wrong. This time, they said that all children are born with blue eyes and the more we learn the more our eyes turn brown, so brown-eyed children are smarter. Just as predicted, the blue-eyed children started to have trouble with their studies and the brown-eyed children improved.

So what might happen if you truly believe you're a great salesperson? What if you were to see, hear and experience every prospect as a great candidate? How do you do this? One way is to make a great first impression; it’s the moment where the Law of Expectation has the greatest impact on your performance. You communicate your expectations by your word choices, voice inflection and body language. When you expect your prospects to buy, all your actions will lead them in the right direction.

Before each sales meeting, try asking yourself, "How do I expect this sales process to go?" If your other-than-conscious mind feeds back a negative response, mentally rehearse the end result you want in full color with sound and feeling. You may want to imagine the prospect signing an order form or handing you a check. Now picture yourself smiling and shaking hands with your new customer. Know that you’ve just done a great service. When you spend time rehearsing success, you’ll be comfortable with it when it happens.
