New York Divorce Lawyer Summaries

By: David Siegel

The above principals cannot be applied in a rigid or mechanical fashion but require the trial court to exercise discretion. In re Tatham. The standards applicable to determining jurisdiction cannot be applied in a mechanical fashion, but require the exercise of discretion by the trial court. In re Kehres.

Factors Considered

The child's home state, the location of necessary evidence of the child's well being, and the significant relationships of the child or parties to the competing states are considerations to be weighed in determining whether Illinois is an inconvenient forum. In re Rizza.

Inconvenience

-Not Shown Circuit court abused its discretion by declining to exercise jurisdiction on the basic of an inconvenient forum; no other state was or recently had been the home state of the children, no other state had a closer connection than Illinois to the children or their mother, and all evidence regarding the children's present circumstances was available in Illinois. Arulpragasam v. Eisele. Since petitioner agreed that Illinois was the proper forum as late as December of 1994, the trial court did not abuse its discretion in deciding not to decline jurisdiction. In re Tatham.

Interstate Communication by Judges

Intertstate communication by the trial judges is authorized by subsection (d). In re Horne.

Jurisdiction

-Conceding

In a proceeding in which the husband sought to punish the wife for violating the terms of the judgment for dissolution of their marriage by moving to Georgia with their child, the court properly conceded jurisdiction to Georgia where the mother alleged, and the husband offered to evidence to dispute, (1) that Georgia was the child's home state, (2) that all the evidence concerning the child's care, protection, training, and personal relationships was available in Georgia rather than in Illinois; and (3) that she had filed a motion in the Georgia court to enroll the Illinois judgment of dissolution of marriage. In re Blanchard. Trial court did not abuse its discretion in conceding jurisdiction to another state where other state was child's home, has a closer connection with the child and with respondent than did Illinois and there was substantial evidence there, as settlement agreement provided that post decree proceedings would be constructed under Illinois law not filed only in Illinois. In re Walker.

Practical Advice For Using The Law Of Attraction!

By: Adam Price

When the video smash hit "The Secret" was first released, theres been a great amount of people utilizing the law or attraction to create their goals successfully in their lives.

This law has been taught by many of the great modern day masters such as Wayne Dyer, Deepak Chopra and Louise Hay.

The origin of this is as old as the universe itself and even though recently it has reached "fad" status, it's been around forever and exists and works whether we believe in it or not.

It is neither negative or positive, good or bad. It just "is", and that's how the energy that created this world is also. A neutral force that can bring us either plenty of joy, or a great deal of sadness.

Have you ever heard the saying "you move towards what you focus on all day long"? This is just a very simple way of saying the principals of attraction are alive and well in our lives. And that thoughts are things that just haven't manifested or materialized yet.

Picture the following scene: It's a glorious sunny day, you're out on a beautiful green golf course and the scent of the freshly cut grass gently lingers in the air. As you approach the tee, you notice a big dam or water right in the middle of the fairway... Ooougghh!! How many of you just focussed on the water when I said that?

My guess would be that about 98 percent of you did, especially if you're a golfer, and quite a number of you would hit the ball directly into the water (even if you've been playing a great game up till that point).

Why?

Because what we focus on expands. When we first become aware of something risky in life, our "pre-conditioned" responses kick in that we've learnt from our loved ones, the news, radio or television, that we need to be what?... Careful, something bad might happen. Right?

But the situation up until that point was non-existent until you thought about it. When you did it became real (in your mind) and you began to focus on it and even obsess about the outcome.

This produces a fear thought in your mind, and the law of attraction goes to work. It draws that fearful thought closer to you because the law of attraction doesn't know the difference between positive or negative (it's neutral). What you just heard, saw or thought about, will indeed come to pass as it becomes more and more real.

If you can grasp this concept you'll understand how the law of attraction works.

The power that created the earth, the stars, the planets, also created us, and this invisible power is also within us...

"We are that power of attraction which created the universe!"

We, as human beings are nothing more than a magnetic, electrical energy force, which has the power of the cosmic mind inside it. And we created ourselves to exist on this earth as we are.

As waves of invisible energy directed by our pure thought. We created ourselves by attracting a cluster of particles to form our bodies. This thought energy allows us to manifest anything we wish from the invisible world of energy waves into whatever we desire, whether it's health, wealth or in connecting with your higher self.

And through authentic, pure and good intent, we have the ability to picture in our mind the things and conditions we want to live by, and they will appear. This is the law of attraction.

Trusting and dedicated thoughts will most definately, without a doubt, manifest into creation. But if we, as physical beings, try to force these creations, they will slip through our fingers. For you to fully harness the law of attraction, you first need to understand how it operates, it's a delicate, yet very powerful force once you know how to implement it in your life.

I invite your to learn more about the law of attraction and ultimate success for your life. You may not fully understand it, but if you've read this far, you will at least know that you attract everything into your life for a reason, as it was your thought that led you to be reading this page.

When you learn more about the amazing law of attraction, and how to manifest abundance in your life, you will truly never go back to the limited way of thinking that you once knew.

I hope you've enjoyed reading this, as much as I have enjoyed preparing it for you. With love, peace and pure intention.
