Understanding How Divorce Law Works

In the case where you are considering divorce, almost regardless of the reasons behind your decision, it is important that you be aware of just what is involved in obtaining a divorce in the US.

In general, the laws of each state set out specific reasons for a divorce which have to be proven before the court is allowed to grant it. This can be under a no-fault heading, an all-fault heading, and a summary heading. In recent years some less adversarial ways to approach to divorce settlements have emerged, like mediation and collaborative divorce, to negotiate mutually acceptable resolutions to conflicts for a couple.

At-fault divorces were originally the only way to dissolve a marriage, and people who had differences or problems were only able to separate, and were prevented from legally remarrying afterward. The state of New York is the only one which still requires fault to obtain a divorce. In an at-fault divorce, one party usually brings divorce proceedings against the other due to some breech of marriage regulations like adultery, abandonment or cruelty.

Comparative rectitude is the name given to a doctrine used to determine which spouse is more at fault in divorce proceedings when both spouses are found to be guilty of breaches. This kind of divorce can affect the distribution of property, and will allow an immediate divorce, especially in states where there is a waiting period required to obtain a no-fault divorce. A defense for this type of divorce can turn out to be expensive and is not usually practical since most divorces are eventually granted anyway, especially when a society comparable to that in the US is not interested in forcing people to remain married any longer. Remember, marriage in the US also has legal ramifications, so if you do not want to be married anymore, you need to get divorced, it is much more than simply taking the mental attitude of no longer being married.

Under a no-fault divorce set of rules, a marriage partner does not need to show that the other marriage partner did anything, or was at fault in order to obtain a divorce. Many common reasons for no-fault divorce can be incompatibility, irreconcilable differences, and irremediable breakdown of the marriage. In the United States, currently 49 states have adopted no-fault divorce laws.

In states that grant no-fault divorces, there may be a waiting period of up to a year before the divorce is considered final. Other requirements include mandatory counseling to see if reconciliation can be achieved if one party does not agree to the divorce, either dependent on an amount of time set by the court, or for a predetermined amount before the divorce may even be applied for,

A summary (or simple) divorce, available in some jurisdictions, is used when spouses meet certain requirements for eligibility, or can agree on important issues beforehand like if it was a marriage lasting under 5 years, there were no children (or, in some states, the couple have resolved custody and set payments for child support), there was minimal or no real property (there was no mortgage on a house or condo), the property owned by the married couple is under a threshold (around $35,000, not including vehicles), and the personal property of each spouse is under a set threshold (typically the same amount as marital property). A simple divorce where both couples agree on how the divorce should be handled and assets divided is also known as an uncontested divorce.

It is estimated that in the US upwards of 95% of all divorces are uncontested, since the two parties are able to come to an agreement (with or without lawyers/mediators) about the property, children and support issues. When the parties are able to agree and present the court with a fair and equitable agreement, approval of the divorce is almost certain. In the case where the two partners cannot come to an agreement, they may ask the court to decide how to fairly split property, deal with children and custody issues, and so forth.

Residency requirements to file for a divorce vary from state to state. In some states, like Colorado, residency requirements are very liberal to accommodate military personnel who have to move often for tours of duty, while other states, like New York, require that you live in them for a minimum of a year with the intention of making this your permanent state of residence. A spouse may separate, move to a state with divorce laws of their choice, establish residency, and file. However, this typically does not change the state in which property and other issues are decided, and it is possible for a court to decide not to hear a petition for divorce if it decides that it does not have legal jurisdiction to do so based on residency issues.

A final consideration to be made when considering where/if to file for divorce is the laws concerning the distribution of property and division of assets. States like Alabama are considered to be an “equitable distribution” state which means that all property acquired during the marriage is divided equally among the two parties. In other states, like California, assets can be awarded to a spouse from the other based on economic need, and in still others, like Alaska, even though it is an equitable distribution state, in some jurisdictions in the state, women have little or no rights to marital property. In some states, alimony is awarded to the stay-at-home spouse, where in others, alimony is paid by the spouse making the most to the spouse making the least, despite the one needing to get child support because they have actual custody.

“Alternative Notions of Life, a Different Path: Guardian Angels ...

One time, when I was a young man of about 23 years old, I bought a small, starter home in Marietta, Florida. It was about 25-30 minutes away from the Navy Base where I was assigned. The house was tiny and old. It was warmed by heating oil from a fuel tank located behind the house.

Winters in this upper part (almost Georgia) of Florida were very cold.

- One Thing after Another -

I was a low ranked enlisted man and newly married. We constantly struggled to make ends meet. Then the wife got laid off from her job.

Unexpectedly, a cold front came in from nowhere – way too early than all forecasts. And, as you would expect, we were out of heating oil and money.

I had never felt so helpless in all my life. Negativity entered my mind and I just sat on my front porch, feeling almost paralyzed, bundled up in two pairs of pants and three coats.

My wife tried to console me, but all I could think about was how much of a failure I was. No matter how much I tried to plan out our budget, something always seemed to pop up.

Many times I would have to get advance loans on my paycheck. These advances were ridiculously expensive – sometimes 20-30% interest, not including the up-front processing fees!

Of course, that just left me starting the next month with a smaller paycheck.

- Distraction or Serendipity -

Yes, I was feeling sorry for myself. How did I get this way? I always worked very hard. I was never extravagant in any area of our financial matters. How? Why? It just didn’t make sense at the time.

Then, some activity in the house across the street distracted me; momentarily freeing me from the current “woe-is-me syndrome.”

It looked like my neighbor was moving.

I had known the old man for about eight months (the total time I was at home from military operations in the last year and a half). Because he seemed so lonely, I always made it a point to say hello. I helped him with his yard when I could, and let him tell me about his life.

The man’s solitary situation reminded me how lucky I was to have my wife. I was instantly filled with a great sense of gratitude for the love and companionship of my wife. Although we were going through some rough times, we always seemed to remember what we really meant to each other.

Now it looked like this lonely, old man was moving?

I hoped everything was going to be okay for him. I didn’t see a “for Sale” sign in his yard, so I walked across the street and peered into his open front door. Yes, all his things were all boxed up. When he walked into his living room carrying another box, I took it from him and placed it next to the others.

After chatting for a bit, he told me that his daughter and husband extended an invitation to live with them up north; and that he was eager to be around his grandchildren. I sincerely wished him good luck and asked him if he needed help with anything else.

Then something miraculous happened.

The man told me that everything was done except for one thing. He had to stay for two more days because the people he was paying to drain his heating oil tank were too busy! Immediately I volunteered to do it for free!

He was overjoyed.

I was stunned.

He was totally unaware of my desperate need for heating oil and was simply happy to be leaving earlier.

Can you believe it?

One minute I’m feeling sorry for myself because I thought my wife and I would freeze; and now my neighbor was giving me a full tank of heating oil – enough to last for at least three payday periods!

- Universal Laws in Action -

The Law of Attraction: Like causes attract like effects. Being positive attracts more positive things into your life; while negativity attracts more negative things.

The Law of Cause and Effect: Sowing and reaping, karma, or “what goes around comes around,” etc. You literally get back what you dish out. It is true that no bad deed goes unpunished. If you live by the sword, you die by the sword.

The Law of Cause and Effect goes hand in hand with the Law of Attraction. These laws govern all our lives (and the rest of the Universe). They operate perfectly and without prejudice – all the time.

- Accumulated Returns -

Good deeds always result in some form of goodness coming back to you. In fact, whether negative or positive, the result that “rebounds” back from the universe will often be many times larger than what was initially “thrown” out there.

Here’s a simplified explanation for this “multiplied rebound” phenomena:

When you act or think, the effects of your actions and thoughts spread out through the universe like the ripples made when a pebble is thrown into calm water. As your effects travel outward into the universe, they touch everything in its path. In turn, those affected - from the furthest to the nearest – respond with their own “ripples” back towards you.

Each response is added to the group of “returning ripples;” eventually growing into a “returning wave.”

Depending on how far in the universe and how many were affected by your thoughts or actions, the accumulated return from the universe could be the size of a small wave; or the size of a good surfing wave; or the size of an enormous tsunami!

- Heating Oil and Universal Laws -

Now, I understand why the above “heating oil” event unfolded the way it did.

In the beginning, the negativity and self-pity I kept focusing on actually attracted more of the same (Law of Attraction). When I replaced the negative thoughts with gratitude (the love of my wife), things immediately changed for the better.

When I stayed positive and offered to help the old man, the universe responded in kind; giving me a massively good thing in return (the heating oil)!

And I re-examine my other “guardian angel,” miracle experiences, it all really makes sense now. Whenever I obeyed the Universal Laws setup by the Original Substance (God), something or someone always appeared out of nowhere to help me in my hour of need.

Michigan Bankruptcy Law Helps You Choose the Bankruptcy Act for You

The word bankruptcy conjures up frightening images of your entire life collapsing around your ears. In this nightmare you feel as if you have no one to help you. This is not the case as the various states have various laws like the Michigan bankruptcy law, to help you out. These laws can help you choose the type of bankruptcy act that will be the most helpful for your situation.

Before you can apply for a bankruptcy hearing Michigan bankruptcy law requires that you go through with credit counseling at an approved government counseling agency at least 6 months before you file for bankruptcy.

As the bankruptcy process can be very complicated you might want to ask a bankruptcy lawyer to explain the Michigan bankruptcy law. This way you will understand what is needed from you before the courts can state that you are bankrupt.

Before you start the process of bankruptcy filing you will need to gather all of the documents that are needed by Michigan bankruptcy law to prove that you need to be declared bankrupt.

The documents that you need will include any deeds and titles to land and vehicles that you own, loan documents, your tax returns for the last 2 years, property and assets, all secured and unsecured debts with the names of the creditors listed, monthly living expenses, and major financial transactions for the last 2 years. You will also need to itemize your current income sources.

Once these various documents have been presented to your bankruptcy lawyers you will be required by the Michigan bankruptcy law to undergo a means test. The means test will be based on your monthly income and living expenses.

The Michigan bankruptcy law is designed to protect you from being harassed as you try to settle the various debts that you have. The act of declaring that you are bankrupt should only be taken if you have no other course left open to you.

There are many different ways that you can get rid of the many debts that you have accumulated. These ways can include going to bankruptcy courts but you should know what is recommend for the bankruptcy courts in your state. The bankruptcy Michigan law requires that you go through with credit counseling before you apply for bankruptcy.

The bankruptcy Michigan law has incorporated the new bankruptcy act in their laws regarding bankruptcy. In this law you will have to attend a court approved credit counseling agency sessions at least 6 months before you can receive a certificate that will allow you to apply for bankruptcy.

Once you have qualified to begin the process of bankruptcy you should contact a bankruptcy lawyer as this person needs to give you a, means test. For chapter 13 you will need to have your repayment plan with all of the repayment details clearly given. This way the court will be able to see if you are sincere in your desire to get rid of your debts. Once the court and your creditors are sure that you will be able to repay the debts that you have owing you will be able to file for bankruptcy.

Once the process for both of these bankruptcy cases has begun you will need to gather the various paperwork that you need. This paperwork will include an itemized list of your current income sources, the major financial transactions that you have carried out for the last 2 years, and your monthly living expenses.

You will also need other items to satisfy the bankruptcy Michigan law act. Your various secured and unsecured debts must be readied to be handed over to your lawyer and then the court. Any property and assets that aren’t exempt for the bankruptcy Michigan law must be handed over along with any title deeds.

The paperwork for your bankruptcy case will include your tax returns for the past 2 years and any loans of yours. Once this information is ready you can file for bankruptcy. The courts of Michigan will issue an automatic stay if you have proved that you are in severe financial difficulties.

Once you have paid your debts the bankruptcy Michigan law will issue a discharge notice. You will however have to undergo a financial management instructions counseling session. When all of these details are seen to you can start your new life.
