What Does The Law Mean To You?

Although we all have an understanding of what law is, and generally why it's appropriate that it should be in place to serve and regulate our conduct in society, we seldom think of what law actually means in an everyday context. What is law for the average Joe in the street? How does law impact on our lives from day to day? Indeed, is the law a distant concept with which we find it hard to relate? In this article we will look at some of the fundamental ways law operates in society, in addition to the nature of the law as we know it.

For some people, they feel as though the law is there merely to protect their interests, and that they have no need for daily interaction. However, they assume that if the day comes where their behaviour is called into question, the law will operate, the course of justice will be run, and the will of the people will be fulfilled. This is perhaps a naïve interpretation of the function of law, and indeed the way it operates in our lives throughout the day. For instance, at the top level we have the constitution, establishing parameters within which the government can and cannot act to protect the citizens of our nation. That has an overwhelming effect on the way in which our government and indeed our country is run, which has a knock on effect on everything we do throughout the day and how we do it. Even at a local level, the law interacts with the services we are provided, the jobs we work and pretty much everything to do with the lives we lead. A distant concept? I don't think so.

The law does not just operate in criminal spheres, nor is it confined to merely constitutional matters and the distribution of power. Law is a significantly more sophisticated tool in the orchestration of the day-to-day organisation of society, through regulating not only personal conduct but also the way we act in business situations. Take for example the everyday task of boarding a train. The law regulates many aspects of this feat: (1) the criminal law and the constitution permits us to board public transport. (2) The constitution permits us to make contract with another. (3) The laws of contract permit us to form a contract for transport with the train company, and ensure that that contract is fulfilled. (4) The laws of contract and tort allow us to board without fear of injury, or with remedy should the worst happen. Finally the law of ownership and currency allows us to hand over money in consideration for this service, which is of value to the other contracting party. In fact, the law regulates just about everything we do, and is vital in doing so to ensure the smooth running of community and every aspect of our lives.

The law is not some abstract notion that can and will protect us when we need to rely on it. The law is an integral part of democratic life, and something which regulates our conduct, and in essence allows us to act according to our own desires within reason. Some may think the law is too restrictive in certain areas, but it works. The law serves its function as regulating our behaviour very well, and if it doesn't? We can change it.

The fact is, law has been an important part of society since it began, with implied legal and social orders and boundaries that could not be crossed. Today, it is a sophisticated network of guidelines and regulations which is adapted to shape the way we live our lives from one day to the next. There is no doubt that the law is important to the citizen, and plays a profound impact on the lives of the people on a daily basis.

Constructiveness is the creative instinct of the mind. It will be readily seen that every successful business man must be able to plan, develop or construct. In the business world it is usually referred to as initiative. It is not enough to go along in the beaten path. New ideas must be developed, new ways of doing things. It manifests in building, designing, planning, inventing, discovering, improving. It is a most valuable quality and must be constantly encouraged and developed. Every individual possesses it in some degree, because he is a center of consciousness in that infinite and Eternal Energy from which all things proceed.

Water manifests on three planes, as ice, as water and as steam; it is all the same compound; the only difference is the temperature, but no one would try to drive an engine with ice; convert it into steam and it easily takes up the load. So with your energy; if you want it to act on the creative plane, you will have to begin by melting the ice with the fire of imagination, and you will find the stronger the fire, and the more ice you melt, the more powerful your thought will become, and the easier it will be for you to materialize your desire.

Sagacity is the ability to perceive and co-operate with Natural Law. True Sagacity avoids trickery and deceit as it would the leprosy; it is the product of that deep insight which enables on to penetrate into the heart of things and understand how to set causes in motion which will inevitably create successful conditions.

Tact is a very subtle and at the same time a very important factor in business success. It is very similar to intuition. To possess tact one must have a fine feeling, must instinctively know what to say or what to do. In order to be tactful one must possess Sympathy and Understanding, the understanding which is so rare, for all men see and hear and feel, but how desperately few \"understand.\" Tact enables one to foresee what is about to happen and calculate the result of actions. Tact enables us to feel when we are in the presence of physical, mental and moral cleanliness, for these are today invariably demanded as the price of success.

Loyalty is one of the strongest links which bind men of strength and character. It is one which can never be broken with impunity. The man who would lose his right hand rather than betray a friend will never lack friends. The man who will stand in silent guard, until death, if need be, besides the shrine of confidence or friendship of those who have allowed him to enter will find himself linked with a current of cosmic power which will attract desirable conditions only. It is conceivable that such a person should ever meet with lack of any kind.

Individuality is the power to unfold our own latent possibilities, to be a law unto ourselves, to be interested in the race rather than the goal. Strong men care nothing for the flock of imitators who trot complacently behind them. They derive no satisfaction in the mere leading of large numbers, or the plaudits of the mob. This pleases only petty natures and inferior minds. Individuality glories more in the unfolding of the power within than in the servility of the weakling.

Individuality is a real power inherent in all and the development and consequent expression of this power enables one to assume the responsibility of directing his own footsteps rather than stampeding after some self-assertive bell-wether.

Inspiration is the art of imbibing, the art of self realization, the art of adjusting the individual mind to that of the Universal Mind, the art of attaching the proper mechanism to the source of all power, the art of differentiating the formless into form, the art of becoming a channel for the flow of Infinite Wisdom, the art of visualizing perfection, the art of realizing the Omnipresence of Omnipotence.

Persuasion and Influence – The Powerful Law of Association

Wonder why many big companies choose famous TV stars to appear in their commercials and not normal people? It's because those stars are famous. They represent wealth, reputation, skills, or popularity. When they endorse a product, you associate that star with the product. Hence, if you like the actor, you will get to like the product. And if you use the product, you tend to feel like the endorser too. This is what we refer to in the field of persuasion and influence as the law of association.

Big companies pay professional athletes large sums of money to wear certain shoes or clothes, endorse their perfumes, drive a specific car, or even eat certain foods. You might be wondering why these athletes are even asked to endorse products that are not related to them or their craft. Persuasion and influence is at work here. As long as the association is positive, it is not necessary that the correlation between the sports star and the product be directly related.

Certain people choose their friends very carefully because the behavior or actions of the people they hang out with can very much reflect on them. If you have a friend who later became a criminal, you had better watch your back because those who want to avenge may pour their bitter revenge on you, no matter how innocent you are! Be aware of this persuasion and influence principle before you associate to anyone or anything.

This is even more difficult if you have family members or relatives who portray negativities. Since we cannot choose them the same way we can select our friends, we are often strict in wanting our family members to conform to good moral values and ethics that reflect our own. Parents want their children to observe proper conduct because other people associate their children with their father and mother.

When their kids win contests or exhibit great talents, their parents are always proud to associate with them and say, “That’s my son (or daughter).”

That's the power of association at work, and it's not limited to people. In fact, you can associate the quality of a person, place, thing, event or anything you can think of, with the subject of your persuasion and influence.

Just think about the clothes that people are wearing. What would you think of a person wearing a cross necklace? You would probably think he is religious. You might associate someone in military attire as disciplined and brave, while someone wearing shades as cool.

If you want to make them feel something they've experienced in the past, you may say something like, "Remember the last time we went nature-tripping? It was the most invigorating experience we've ever experienced, isn't it? We're going to experience it again in the trip we're going."

The purpose is to alter the mindset and emotion of the person you're persuading by using the right key of association. You want them to associate you or your product with positive emotions, ideas or factors. The power of persuasion and influence is fascinating, isn’t it?

Divorce and Family Law Case Update

Cost of Living Increase

Evidence presented to the trial court indicated that the cost of supporting a child had substantially increased and that defendant's income had substantially increased so as to enable him to pay this additional amount; in light of this evidence it was error for the trial court not to order the defendant to pay modified amount plaintiff sought for child support.

Death of Obligor Subsection (c) of this section provides that the obligation to support, unless otherwise agreed in writing or provided in the judgment, will survive the death of the parent obliged to provide child support and seeks to protect the dependent child of divorced parents from loss of support through disinheritance, a loss from which a child of non-divorced parents is indirectly insulated.

An order under 750 ILCS 5/513 for education and maintenance of a child, whether of minor or majority age, is intended to be included within subsection (c) the same as a support order and is not terminated by the death of a parent obligated to pay for these expenses. An order of support for a non-minor child, although only to be granted under special circumstances under 750 ILCS 5/513 is the same as any other order of support and does not terminate upon the death of the parent obligated to pay the support unless otherwise agreed in writing or expressly provided in the judgment. Subsection (c) authorize modification of child support, when a parent obligated to pay support dies, "to the extent just and appropriate in the circumstances"; however, no modification of a support order is warranted where the decedent has adequately provided for the children.

No modification of a support order is warranted where the person obligated to pay support has adequately provided for the children in a testamentary device. Subsection (c) of this section seeks to protect the dependent child of divorced parents from loss of support through disinheritance, a loss from which a child of nondivorced parents is indirectly insulated; a divorced parent is still free the disinherit a child of his divorced marriage, subject only to the limited obligation of support. Since an original decree made no provision for support of the minor children by the father, the former wife's petition filed after the father's death constituted in effect an effort to enforce a claim against plaintiff's estate for child support unrelated to the divorce decree, and, since the death of the plaintiff rendered it impossible for the trial court to enter any personal decree against him, there could be no basis for granting relief provided by an amended decree under former Ill.Rev.Stat., ch. 40, para. 19.

Delayed modification

Where at the time the petition for modification was filed, the defendant was receiving his full salary, he had incurred additional expenses because of a heart attack, but he had also recently received an inheritance, the trial court properly found that reduction of his alimony and support payments was not justified at the time of the filing of the petition, but that a modification was justified effective six months later.

Determination

Support should be determined by accommodating the needs of the children with the available means of the parties.
