A beautiful art piece is a portrayal of the mind's creativity. It is a display of various expressions, facets and forms of life. Collecting attractive art pieces is a passion for art freaks and mesmerizing pleasure for common populace. Nobody can refrain himself from adulating the eternal beauty of a marvelous painting. However, the elements of fraudulence and forgery have made the requirement of an art lawyer indispensable, when it comes to buying or selling the original art pieces.
An experienced and competent art lawyer is a solution to various art related issues and cases. It is not that one can consult an art lawyer only for fraud art cases, his presence is also very important while buying and selling the art pieces. It is often said that collecting art is an expensive hobby, especially when you wish to buy a particular painter's creation from different sellers or art agencies. You must check for the authentication and certification of the firm and this can be easily speculated by an art lawyer. This is because they are professional lawyers and know about all the aspects related to fraudulent art piece suppliers. Their experience and professional approach will gage the authentication of the seller in the most practical and legal manner. Therefore, if a person is accompanied by any such lawyer during the time of purchasing art pieces, he can surely save a lot on his money and time. In addition to this saving, there will be no added pressure and pain of investing in a duplicate or morphed art piece.
Art is a universal interest. It is not that only hard core art lovers like to indulge in the pleasure of gathering creativity. Many people wish to buy good and attractive art pieces for the purpose of decoration. Captivating paintings given entirely different look to the offices, homes, studios, shopping complexes and other places. Bright utilization of colors is considered extremely effective in enlightening the ambiance and boosting up the spirit of people at work. Therefore, it is not wrong to say that art pieces are favored by all sects of society and it is not compulsory that everyone will have good information and right knowledge to judge the originality of the art pieces. It is for this reason, many people contact with a qualified Art lawyer who can guide them the entire procedure. Lawyers can also offer a list of reliable and registered art and paintings sellers.
Finally I would also like to add an important point, that it is not always the customers who seek assistance of an art lawyer; even the sellers have to consult these lawyers in few cases. Many times, the buyer refuses to pay the actual quoted price of an art pieces and then only a lawyer can help the seller in extracting the required money in a legalized manner. So, if you find any similarity to such situation, instantly search for an art lawyer. You can easily find good results to your search on Internet. Nowadays numerous law firms are sincerely assisting people in fighting against the art cases.

Insurance law can help you more in litigation
By Kendy Smith
Business is a smooth street for every business. They have to meet a lot of risks in management and business. Especially, professionals are always at risk of being sued for loss or damage caused allegedly by mistake, omission, negligence or other error. The range of claimants is virtually endless. Today's client may well be tomorrow's plaintiff/applicant. This article sets out the ways in which professionals can manage the risk of litigation by third parties, former clients, disgruntled staff or even Commonwealth and State Government instrumentalities.
Importance of Adequate Insurance
Insurance is a form of both risk transfer and risk financing. Insofar as a claim falls within an insurance policy, financial burden is transferred from insured to insurer. Alternatively, the insurer provides to the insured sufficient funds to pay third party demands.
Professionals such as architects, accountants, engineers, medical practitioners, quantity surveyors, lawyers, physiotherapists and others should consider a matrix of insurance to assist financial survival and then financial success.
Professional Indemnity
This policy provides cover for breaches of duties owed in a professional capacity as a professional practicing in a specific area. The protection is in relation to claims made against the professional and notified to the insurer within the period of insurance.
Public Liability
This insurance protects professionals against legal liability for personal injury and damage to property of third parties which arises in a non-professional context. Not everything a professional does in his or her business is a professional act. For instance, a building surveyor may be responsible for personal injury or property damage on a building site as a result of carelessness - e.g. causing a tripping, slipping or falling hazard at a building site or at the surveyor's office or at a client's business during visits before a professional relationship exists or after one has concluded which subsequently caused personal injury or property damage. There will be a number of exclusions including liability arising within a professional context.
Directors & Officers Liability
Where professionals practice via a company, they may be directors or senior officers. Particularly in larger private companies working as professionals, directors and senior corporate officers owe a variety of statutory and common law duties to a wide variety of persons such as shareholders, creditors and employees. For instance, company directors face civil liability and fines if they allow their companies to trade whilst insolvent. Directors may face personal liability if they discriminate against employees or potential employees when hiring or firing staff. Likewise, directors cannot give preference to certain classes of creditor if the company is facing insolvency or liquidation.
Business Interruption
Busy professionals, I suspect, give little thought to what would happen to their business if the premises from which they practice is destroyed by mundane risks such as fire or storm let alone more exotic risks such as terrorist action, civil unrest or nuclear radiation. In reality, a professional practice can be badly affected if the business is interrupted and cannot be carried out because buildings have to be rebuilt, offices have to be re-furbished, records need to be re-written and replaced and businesses need to be relocated, either temporarily or permanently. The cost to professional practices of this interruption is insurable through business interruption insurance.
Accident & Health/Income Protection
Many professionals practice in small partnerships or as sole practitioners. Most professionals have been very busy in recent times. Most professionals tend to assume that the money will keep on being generated indefinitely. What happens, however, if you befall a non-work work-related injury or illness which prevents you from working for a lengthy period of, say, three months, six months, twelve months etc? If you practice on your own, who will take over the responsibility for running your files? Who will generate the professional fees which you and your family need to live on? Who will pay for locums to run your practice? Accident & Health Protection policies, whilst expensive, do provide income streams in these circumstances.
Employee Dishonesty
Sometimes, employees of professional practices will have access to client funds, particularly where multiple permits and inspections are being organized where building estates with multiple allotments are created. This insurance provides coverage for employee theft of client funds. It is sometimes known as fidelity guarantee insurance.
Statutory Fines & Penalties
Traditionally, this type of insurance supplements professional indemnity policies. It provides coverage for the cost of lawyers in defending misconduct cases brought by disciplinary organizations such as the Building Registration Board, the Building Appeals Board, the Building Commission, the Medical Practitioners' Board, the Royal Australasian Institute of Architects, and the Victorian Legal Services Commissioner etc. The legal fees you may incur in defending such cases are indemnifiable whether the charge is established or not. Other policies go further and seem to provide indemnity for the final penalty imposed. You need to read those policies very carefully. They may be contrary to public policy. It would be wise to seek legal advice before paying premiums for those policies.

Tacoma Family Law: What Do I Do to Start a Divorce?
By Susant Sahoo
The decision to seek a divorce is not an easy one. It is one only you can make, and no lawyer can help you. However, once you have decided to file for divorce you then have to decide whether to use a Tacoma family law attorney or to represent yourself. While this decision is also yours to decide, making an informed decision requires some knowledge of Tacoma family law procedures and substantive law.
In order to start a divorce action in Tacoma, you must first file a Summons and Petition for Dissolution in the correct court. If your case is out of Tacoma, it is likely that the correct court is Pierce County Superior Court. However, the legal issue involved here is known as “jurisdiction”. It basically means that in order for a court to hear your case, that court must have power over the parties and the subject of the case. There are a myriad of jurisdictional rules involved in Tacoma family law, and these should be explained by a competent Tacoma family law attorney.
Let’s say, though, that you have filed in the right court. The next step is to serve the other party with the Summons and Petition. This, too, is an issue with some Tacoma family law rules attached to it, and must be followed correctly in order to count as sufficient service.
Once service is accomplished the next question would be, do you need temporary orders? That is, do you need a judge to order the payment of child support and spousal maintenance in order for everyone to get by financially? Do you need a Tacoma family law court to enter orders restraining either party from draining bank accounts, selling property, taking a child out of state, or even from coming onto the premises of the other party to prevent confrontation? These orders can be entered by way of a pre-trial motion and are a significant part of a Tacoma family law lawyer’s contribution to the case. Knowing how to file, frame, and argue such motions takes experience with and knowledge of Tacoma family law processes, something professional lawyers have to offer.
Finally, think about how your divorce will be finalized. When the court enters a decree of dissolution, an order that says a marriage is dissolved, it rules on a number of issues. First, it enters a parenting plan and a child support order if there are children at issue. Child custody is the most difficult area of Tacoma family law, and you should think about what the disputes will be in your case. Will you and your spouse agree on which of you will be the primary parent? Will the non-residential parent pay reasonable child support, or will he or she fight it by hiding income? Also, the court will rule on how the community and separate property in the marriage will be divided between the parties. Ask yourself if this will be a hot debate, or will a Tacoma family law court have to divide your property for you.
As you can see by these simple questions, divorce can be serious, and the assistance of a Tacoma family law lawyer can be invaluable. If you are thinking of divorce, contact the Tacoma family law firm of McKinley Irvin. We have been helping our community with divorce, child custody, child support, and other Tacoma family law matters since 1991.
